By using CivicAlert, you agree to these Terms of Service. Please read them carefully. If you do not agree to these terms, you may not access or use our platform.

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of CivicAlert's emergency incident reporting platform, including our website, mobile applications, and related services (collectively, the "Platform").

By creating an account, accessing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

2. Eligibility

To use CivicAlert, you must:

  • Be at least 13 years of age (or the age of majority in your jurisdiction)
  • Have the legal capacity to enter into binding contracts
  • Not be barred from using the Platform under applicable law
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials

3. User Responsibilities

3.1 Accurate Reporting

You agree to provide truthful, accurate, and complete information when reporting incidents. False reports may result in account suspension, legal action, and could endanger lives by diverting emergency resources.

3.2 Appropriate Use

You agree NOT to use the Platform to:

  • Submit false, misleading, or fraudulent incident reports
  • Harass, threaten, or intimidate other users or emergency personnel
  • Upload malicious code, viruses, or harmful software
  • Violate any local, state, national, or international law
  • Infringe upon intellectual property rights of others
  • Collect or harvest personal information of other users
  • Interfere with or disrupt the Platform's operation
  • Impersonate any person or entity, including officials or administrators

3.3 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access or security breach.

4. Emergency Services Disclaimer

IMPORTANT: CivicAlert is NOT a replacement for emergency services.

  • In case of immediate danger or life-threatening emergency, call 911 or your local emergency number FIRST
  • CivicAlert serves as a supplementary community reporting tool
  • Response times may vary and are not guaranteed
  • The Platform should not be solely relied upon for emergency response

5. Content and Intellectual Property

5.1 Your Content

You retain ownership of content you submit (photos, descriptions, comments). However, by submitting content, you grant CivicAlert a worldwide, royalty-free, non-exclusive license to:

  • Use, reproduce, and display your content on the Platform
  • Share incident information with emergency services and relevant authorities
  • Distribute verified incident information to community members
  • Use anonymized data for public safety research and analysis

5.2 Platform Content

All content, features, and functionality of the Platform (excluding user-submitted content) are owned by CivicAlert and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express permission.

6. Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using CivicAlert, you consent to our data practices as described in the Privacy Policy.

We may share incident information with emergency services, law enforcement, and relevant government authorities to facilitate emergency response. This sharing is necessary for the Platform's core purpose.

7. Verification and Moderation

CivicAlert employs administrators and automated systems to verify and moderate incident reports. We reserve the right to:

  • Review, verify, or reject any incident report
  • Remove content that violates these Terms or our policies
  • Suspend or terminate accounts for violations
  • Modify incident categories, severity levels, or status
  • Contact users for additional information or clarification

8. Disclaimers and Limitations of Liability

8.1 Service "As Is"

The Platform is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, secure, or error-free operation of the Platform.

8.2 Limitation of Liability

To the fullest extent permitted by law, CivicAlert shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of life, injury, property damage, or lost profits, arising from your use of the Platform, even if we have been advised of the possibility of such damages.

8.3 User-Generated Content

We are not responsible for the accuracy, completeness, or reliability of user-submitted incident reports. Users rely on reported information at their own risk.

9. Indemnification

You agree to indemnify, defend, and hold harmless CivicAlert, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of another user or third party
  • Any false or misleading information you submit

10. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for:

  • Violation of these Terms or our policies
  • Submission of false or fraudulent reports
  • Abusive or harmful behavior toward users or administrators
  • Any activity that threatens public safety or the Platform's integrity
  • Inactivity for an extended period

You may delete your account at any time through your account settings. Upon termination, your right to use the Platform will immediately cease.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the "Last Updated" date. Your continued use of the Platform after changes constitutes acceptance of the modified Terms.
